Since February 1st, 2017, in accordance with Section 36 of the German Act on Alternative Dispute Resolution in Consumer Matters (Verbraucherstreitbeilegungsgesetz - VSGB), new regulations apply to EU dispute resolution for online retailers. Here you can find out how to include the information in your legal notice and your terms and conditions or adapt these texts at a later date.
How is this implemented in elopage?
Seller with existing legal notice
For customers who already have a legal notice, we have included in the legal notice and in the terms and conditions (under paragraph 7.4) the text that is relevant for most of our customers and that we also provide in the default version of a new legal notice. "The European Commission provides an Online Dispute Resolution (ODR) platform, which you can find under http://ec.europa.eu/consumers/odr. We will not participate in a dispute resolution process before a consumer arbitration board."
Sellers who are creating a legal notice for the first time
When you create a legal notice for the first time, you can change the corresponding content. In this case you will find the block "Note on EU dispute resolution" below. If you have already created the legal notice, the block will no longer be visible. If the text we have provided is not appropriate for you because you participate in the dispute resolution process voluntarily or due to a legal obligation, then insert your text here.
Sample texts:
- You are not obligated to participate in the EU dispute resolution procedure and do not participate in it: "The European Commission provides an Online Dispute Resolution (ODR) platform, which you can find under http://ec.europa.eu/consumers/odr. We will not take part in a dispute resolution process before a consumer arbitration board."
- You are not obligated to participate in the EU dispute resolution process and participate voluntarily: "The European Commission provides an Online Dispute Resolution (ODR) platform, which you can find under http://ec.europa.eu/consumers/odr. We are willing to participate in an out-of-court arbitration process."
- You are obligated to participate in the EU dispute resolution process: "The European Commission provides an Online Dispute Resolution (ODR) platform, which you can find under http://ec.europa.eu/consumers/odr. To resolve disputes, consumers can contact the arbitration board [name, address, website of the arbitration board]. We are obligated to participate in a dispute resolution process before this board and we will participate in such a process."
